01. ACCEPTANCE OF TERMS

02. ELIGIBILITY REQUIREMENTS

To ensure the health and safety of all pets in our care, all dogs must:

• Be at least sixteen (16) weeks of age.
• Be current on all vaccinations required by applicable regulations, including Rabies, DHPP, and Bordetella.
• Be free from contagious diseases, parasites, fleas, and ticks.
• Be in good health and physically capable of participating in boarding activities.
• Not display aggressive or dangerous behavior toward humans or other animals.

Schultheis Dog Boarding reserves the right to deny or discontinue services for any dog that does not meet these requirements.

03. RESERVATION AND PAYMENT POLICY

Reservations
Reservations are accepted on a first-come, first-served basis and are not guaranteed until confirmed by Schultheis Dog Boarding.

Deposits
A deposit may be required for holiday periods, peak travel seasons, extended stays, or first-time clients.

Payments

• Full payment is due at check-in unless otherwise agreed upon in writing.
• Accepted forms of payment include cash, credit card, debit card, ACH transfer, and approved electronic payment methods.
• Late payments may be subject to additional fees.
• Chargebacks for valid services rendered may result in collection actions and legal remedies.

04. CANCELLATION POLICY

Standard Reservations

• Cancellations made more than 48 hours before check-in are eligible for a full refund of any deposit.
• Cancellations made within 48 hours of check-in may result in forfeiture of the deposit.

Holiday Reservations
Holiday reservations may require a non-refundable deposit and are subject to separate cancellation terms.

05. VETERINARY CARE AUTHORIZATION

In the event of illness, injury, or emergency involving a boarded dog:

• Schultheis Dog Boarding is authorized to obtain veterinary care deemed necessary for the dog's health and safety.
• The owner authorizes transportation of the dog to a licensed veterinarian, emergency clinic, or animal hospital.
• The owner agrees to pay all veterinary, transportation, medication, and emergency treatment costs incurred.
• Every reasonable effort will be made to contact the owner or emergency contact before treatment whenever circumstances permit.

06. MEDICATION ADMINISTRATION

If medication administration is requested:

• Medications must be supplied in original labeled containers.
• Written instructions must be provided.
• Schultheis Dog Boarding will exercise reasonable care when administering medications but assumes no liability for adverse reactions, underlying conditions, or complications beyond its control.

07. OWNER REPRESENTATIONS & DISCLOSURES

The owner certifies that all information provided is accurate and agrees to disclose:

• Existing medical conditions
• Behavioral issues
• Prior bite incidents
• Aggressive tendencies
• Separation anxiety
• Escape history
• Dietary restrictions
• Special care needs

Failure to disclose material information may result in immediate termination of services without refund.

08. ASSUMPTION OF RISK

The owner acknowledges that dog boarding and social interaction involve inherent risks, including but not limited to:

• Minor injuries
• Scratches and bites
• Exposure to illness despite vaccination requirements
• Emotional stress
• Unexpected behavioral incidents

The owner voluntarily assumes these risks and releases Schultheis Dog Boarding from liability except where prohibited by law.

09. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable laws of the State of New York:

Schultheis Dog Boarding, its owners, employees, contractors, and agents shall not be liable for injury, illness, death, loss, theft, or property damage arising from services provided, except in cases of gross negligence or intentional misconduct.

Any damages awarded shall not exceed the total fees paid by the owner for services provided during the applicable boarding stay.

10. PERSONAL PROPERTY

Owners are discouraged from leaving valuable items with their pets.

Schultheis Dog Boarding shall not be responsible for the loss, theft, damage, destruction, or deterioration of:

• Toys
• Beds
• Blankets
• Collars
• Leashes
• Clothing
• Bowls
• Other personal belongings

11. EMERGENCY CONTACT REQUIREMENTS

Owners must provide:

• A primary phone number
• A secondary phone number
• An emergency contact located within the United States
• Veterinarian contact information

Failure to provide accurate contact information may delay communication during emergencies.

12. ABANDONED ANIMALS

If a dog is not picked up within seven (7) calendar days after the scheduled pickup date and reasonable attempts to contact the owner have failed:

• Schultheis Dog Boarding may contact local animal welfare agencies, rescue organizations, or authorities in accordance with applicable laws.
• The owner remains responsible for all outstanding fees, boarding costs, veterinary expenses, and collection costs.

13. PHOTOGRAPHY & MARKETING RELEASE

Unless the owner submits a written opt-out request, the owner grants Schultheis Dog Boarding permission to photograph, video record, and use images of the dog for:

• Social media content
• Advertising
• Marketing materials
• Website content
• Promotional campaigns

No compensation shall be owed to the owner for such use.

14. FORCE MAJEURE

Schultheis Dog Boarding shall not be liable for service interruptions or inability to perform services caused by circumstances beyond reasonable control, including:

• Natural disasters
• Severe weather
• Power outages
• Public health emergencies
• Government orders
• Transportation disruptions
• Acts of terrorism
• Labor disputes

15. PRIVACY POLICY

Client information will be maintained in accordance with applicable privacy laws.

Information collected may include:

• Contact information
• Veterinary records
• Emergency contacts
• Payment information

Information will only be used for business operations, legal compliance, customer service, and communication regarding pet care services.

16. MODIFICATIONS TO TERMS

Schultheis Dog Boarding reserves the right to amend these Terms of Service at any time. Updated terms become effective immediately upon publication or distribution to clients.

17. GOVERNING LAW & VENUE

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York.

Any dispute arising out of or relating to these Terms or the services provided by Schultheis Dog Boarding shall be resolved exclusively in the state or federal courts located within the City of New York, New York, and both parties consent to the jurisdiction of such courts.
